Ruling ng Korte Suprema sa impeachment ni VP Sara, ‘no bearing on merits’ – PBBM

BENGALURU, India —NILINAW ni Pangulong Ferdinand R. Marcos Jr. na ang naging desisyon ng Korte Suprema na may kaugnayan sa in-archive na impeachment case laban kay Vice President Sara Duterte ay tumutugon lamang sa procedural issues at hindi nasaling ang mismong nilalaman ng reklamo.

“Let me clarify. The merits of the case were not examined by the Supreme Court… This does not decide the merits of the case. It just talked about procedure. So the procedure was faulty, was lacking. So that is the assessment of the Supreme Court,” ang sinabi ni Pangulong Marcos sa Philippine delegation reporters sa isang briefing sa kanyang naging state visit sa India.

“It has no bearing on the rightness or wrongness of the impeachment,”diing pahayag ng Pangulo.

Sinabi pa ng Pangulo na wala pang paglilitis at ang nilalaman ng impeachment complaint ay hindi pa napagde-debatehan.

“Again, there has been no trial. So the merits of the case have not been examined, tried, adjudicated, argued, discussed. So, accountability just doesn’t come into it. People have to understand, it is a procedural question,” ayon sa Chief Executive.

“They said the date was wrong, the way the House did it was not correct. It had nothing to do with the contents of the impeachment complaint, but with how the impeachment was handled,” ang winika ng Pangulo.

Sa kabilang dako, iginiit ng Pangulo na walang papel ang ehekutibong sangay ng pamahalaan sa impeachment proceedings.

“I keep telling you, the executive has no role in this. The president has no role. I’m an impeachable officer. I cannot involve myself in any of this. So, it’s really the Supreme Court, the Senate and the House,” anito.

Nauna rito, inaprubahan ng Senado ang paglalagay sa archive ng impeachment case laban kay VP Sara kasunod ng pasya ng Korte Suprema na ito ay labag sa Konstitusyon.

Sa botong 19-4, nanaig ang mosyon ni Senate Majority Leader Joel Villanueva na i-archive ang kaso, bilang tugon sa ruling ng Korte Suprema na nagsabing walang bisa ang reklamo mula sa simula at walang hurisdiksyon ang Senado rito. Si Senador Panfilo Lacson ang tanging nag-abstain.

Ang mosyon ni Villanueva ay nagbago sa orihinal na mungkahi ni Senador Rodante Marcoleta na tuluyang ibasura ang kaso. Tumutol dito si Senate Minority Leader Vicente “Tito” Sotto III, iginiit niyang nagtipon na ang Senado bilang impeachment court, kaya’t may hurisdiksyon ito sa usapin.

Ipinaliwanag naman ni Senate President Francis “Chiz” Escudero na ang pag-archive ay hindi nangangahulugang itinatanggi ang mga naganap, kundi isang legal na pagsunod sa desisyon ng Korte Suprema.

Tinangka ni Sotto na ipatigil ang orihinal na mosyon ni Marcoleta sa tulong ni Sen. Risa Hontiveros, ngunit ito’y nabigo sa botong 19-5.

Binigyang-diin ni Escudero na maaaring muling buksan ang kaso mula sa archive kung sakaling baligtarin ng Korte Suprema ang desisyon nito.
