Giit ng mambabatas…VP Sara, tunay na may pananagutan sa P612.5 million confidential funds ng OVP at DepEd

SI Vice President Sara Duterte ang may pananagutan sa P612.5 million confidential funds ng Office of the Vice President (OVP) at bilang naging Kalihim ng Department of Education (DepEd), ayon kay Kabataan Party-list Rep. Renee Louise Co, tagapagsalita ng House prosecution.

Iginiit ni Co na ang mga special disbursing officers (SDOs) na nangangalaga at namamahagi ng pondo ay ginagampanan lamang ang kanilang tungkulin sa ilalim ng awtoridad ng Duterte.

Ipinaliwanag ni Co ang “command responsibility” ni Duterte sa kilos ng kanyang mga subordinate.

“Pag may pagkakamali ho anuman sa isang document, ‘yung isang inferior government official, meron pa ring responsibility ang supervisor, ang superior officer,” sabi ni Co.

 “Hindi natin pwedeng masabi that the buck stops at just the special disbursing officer. Meron at meron pong responsibility ‘yung higher commanding officer,” dagdag ng kongresista.

Tinukoy naman ni Robert Ace Barbers, adviser at tagapagsalita ng House impeachment team, na sina dating OVP SDO Gina Acosta and dating DepEd SDO Edward Fajarda ay ginampanan lamang ang kanilang tungkulin sa utos ni Duterte.

 “Yes, the head of the agency appoints the SDOs, ito si Fajarda and si Acosta. But to me, they are just mere pawns,” sinabi ni Barbers. 

“Sila lang ‘yung magdi-disburse, at sila ‘yung may authority given by the head of the agency to disburse these funds and make sure that the funds are properly used and properly spent on items that are allowable under the Joint Circular,” dagdag ng dating kongresista.

Pinaliwanag ni Barbers na ang responsibilidad ng mga SDOs ay hindi maiaalis ang pananagutan ng hepe ng ahensiya sa usapin ng confidential funds.

“Kasi nga, siya ang pumipirma sa physical and financial plans, siya ang pumipirma sa liquidation, siya ang pumipirma sa mga iba pang certification,” sabi ni Barbers.

Ayon kay Atty. Benjamin “Jay” Tolosa Jr., legal spokesperson at counsel ng House prosecutors, naging parehas ang posisyon ng prosecution team sa testimonya ni COA auditor Roderick Wamil sa Senate impeachment court.

“His (Wamil) position is, liability’s not on the special disbursement officer alone. In fact, higher responsibility and accountability is placed on the head of agency,” sabi ni Tolosa.

Sa kanyang testimonya, binanggit ni Wamil ang Section 102 ng Government Auditing Code, kung saan ang head of the agency ay “directly and primarily responsible for all funds and properties pertaining to his or her office.”

Idinagdag ni Wamil ang Joint Circular No. 2015-01, kung saan nakalagay na mayroon direktang pananagutan ang hepe ng ahensiya sa paggamit ng confidential funds.

“At makikita rin natin dun sa mga napakadaming certifications and different liquidation reports, documents na pinirmahan ng Bise Presidente, nakalagay doon she is accountable for the use of those confidential funds,” sabi ni Tolosa.
