Kalinga ng Bahay Pag-asa sa mga batang nagkasala sa batas, kinakailangan

ITO ang iginiit ni Manila Rep. Joel Chua sa gitna ng lumalalang isyu kung papatawan ba ng parusa o rehabilitasyon ang mga “Children in Conflict with the Law” (CICL).

“The recent incidents involving children in conflict with the law remind us that accountability and rehabilitation must go hand in hand. One important but often overlooked part of our juvenile justice system is the Bahay Pag-asa,” sinabi ni Chua.

Ayon kay Chua, malinaw sa Juvenile Justice and Welfare Act, as amended by Republic Act No. 10630, na bawat lalawigan o lungsod ay responsible sa pagtatatag ng Bahay Pag-asa sa kanilang lugar.

“Ang challenge ngayon ay hindi yung kawalan ng legal mandate kundi ang mga nag-iimplement nito,” sinabi ng kongresista.

Idinagdag ni Chua na mandato ng Department of Social Welfare and Development (DSWD) at ng Juvenile Justice and Welfare Council na mag conduct ng nationwide assessment para alamin ang mga lugar na walang pang Bahay Pag-asa at kung ano pa ang kinakailangan para mapa- unlad ang mga pasilidad.

Bawat Bahay Pag-asa ay minimum standards sa security, staffing, mental health services, education, skills training, at rehabilitation, paliwanag ni Chua.

“Children who pose a serious danger to others because of the gravity of the offenses they allegedly committed should be housed in appropriately secure units while continuing to receive the rehabilitation and protections required by law,” ayon sa kongresista.

Sinabi ni Chua na pinag-aaralan niya na amyendahan ang mga probisyon ng Juvenile Justice and Welfare Act para magkaroon ng regular compliance audits, congressional oversight, at periodic reporting ng mga lalawigan at Highly Urbanized Cities sa pagtatatag ng Bahay Pag-asa sa kanilang lugar.

“The protection of the public and the rehabilitation of children in conflict with the law are not competing objectives. We can and must achieve both by faithfully implementing and strengthening the law we already have,” sinabi ni Chua.
