3 dating SC justices, dadalo sa Miyerkules ukol sa 16 boto

TATLONG retiradong mahistrado ng Supreme Court ang personal na dadalo sa Senate impeachment court sa Miyerkules upang makatulong sa pagresolba sa usapin kung mananatili ang botong 16 bilang threshold sa paghatol kay Vice President Sara Z. Duterte, kasabay nang pagtalakay sa isinasaad sa konstitusyon na two-thirds requirement para sa 24-member Senate.

Inihayag ni Presiding Officer Sen. Francis “Chiz” Escudero nitong Lunes na sina retired Chief Justices Artemio Panganiban at Reynato Puno at retired Associate Justice Adolfo Azcuna ay dadalo sa senado bilang ‘amici curiae’ or friends of the court ngayong Setyembre 16.

“For the information of the parties and the public, the court formally announces that, as discussed during the trial of Sept. 10, 2026, it has secured the participation of the following legal luminaries as amici curiae on the meaning of all members under Article 11, Section 3-6 of the Constitution, as raised by Senator-Judge Erwin Tulfo,” ani Escudero.

Nakasaad sa Article XI, Section 3(6) ng 1987 Constitution na walang sinuman na mahahatulan sa impeachment trial ng walang pag-apruba ng “two-thirds of all the Members of the Senate.”

Ang senado ay binubuo ng 24 miyembro na nangangahulugan na 16 para sa sinasabing two-thirds na boto.

Ang isyu ay binuksan ni Senator-Judge Erwin Tulfo, para mabigyang linaw ang botohan dala na rin sa ilang senator judges ang hind makaka-partisipa sa proseso.

Magsisilbi rin si Retired Chief Justice Hilario Davide Jr. bilang amicus curiae ngunit hindi na kailangan na personal na humarap sa korte.

“Meanwhile, retired Chief Justice Hilario Davide Jr. shall submit his views through a legal memorandum, which shall be formally entered into the records in lieu of his personal appearance, given that he is recuperating from a procedure,” pahayag ni Escudero.

Sina Azcuna at Davide ay naging miyembro ng 1986 Constitutional Commission na nag-draft sa 1987 Constitution.
