INIHAYAG ni Akbayan Partylist Representative-elect Chel Diokno na maaaring i-carry over o ipagpatuloy sa ika-20th Congress ang impeachment trial ni Vice President Sara Duterte dahil sa pagiging isang continuing body ng Senado sa usapin ng impeachment trials.
“When the Senate acts as an Impeachment Court, it casts off its robes as a lawmaking body and takes on a completely different role mandated by the Constitution: to hear and decide whether the highest ranking officials of Government should be removed from office for culpable violation of the Constitution, treason, bribery, graft and corruption, other high crimes, or betrayal of the public trust,” paliwanag ni Diokno.
Ayon sa mambabatas, habang nagsisilbing impeachment judges ang mga senador ay manunumpa sila ng hiwalay.
Ito rin ang dahilan kung bakit nire-require sa konstitusyon na ang impeachment trials ay dapat gawin agad o ‘forthwith’ dahil ang senado ay magsisilbi ng isang kakaiba o unique judicial function na isinasaad sa saligang batas upang mapanagot ang sinumang mataas na opisyal ng gobyerno.
“While it is true that when the 19th Congress ends, all pending legislative matters and investigations also end, this refers to the Senate’s role as a lawmaking body. It does not refer to the Senate’s role as an Impeachment Court, which is entirely separate, distinct, and special,” paliwanag pa ng Kongresista.
Suportado ito ng kaso ng Pimentel, Jr. v. Joint Committee of Congress (G.R. No. 163783, June 22, 2004), kung saan lumabas sa kautusan ng Supreme Court na ang non-lawmaking functions na nakatalaga sa senado sa ilalim ng 1987 Constitution ay hindi apektado ng pagbabago sa Kongreso at miyembro nito.
Nakasaad pa sa constitutional provisions on impeachment, kabilang na ang requirement para sa mga senador na manumpa ng hiwalay sa tungkulin bilang senador at hukom sa impeachment trial, na ginaya sa konstitusyon ng United States.
“While their precedents are not binding, it is also well settled that in the United States, an impeachment trial is not affected by a change from one Congress to another,” dagdag nito.
Ayon kay Diokno, naiwasan sana ang mga isyung kinakaharap ngayon kung agad pinasimulan ng senado ang trial matapos na i-transmit ang articles of impeachment, batay na rin sa mandatong isinasaad sa 1987 Constitution.
“The Constitution mandates that the Senate must try the articles of impeachment upon transmittal. That’s why, from the very beginning, we questioned why there was no immediate action taken,” aniya.
Aniya pa, may constitutional duty ang senado na magsagawa ng trial at hindi basta-basta ito ibasura sa pamamagitan ng isang resolution.
“The continued delay in the proceedings and the attempt to dismiss the case through a mere resolution are deeply concerning, as they risk underm6ining the rule of law and the democratic principle of checks and balances. The Senate cannot be allowed to escape its duties based on limitations which they themselves seem to have designed,” he stressed, adding that upholding accountability and justice is a constitutional mandate of the Senate and a fundamental part of good governance,” ani Diokno.
Inendorso ng Akbayan Partylist, sa pamamagitan ni Rep. Perci Cendana, ang unang impeachment complaint na inihain laban sa VP noong December 2024.
Nakasaad sa reklamo ang akusasyon ng culpable violations of the Constitution, graft and corruption, bribery, betrayal of public trust, at iba pang high crimes laban sa VP. Na-impeach ito sa kamara noogn Pebrero 5, sa pamamagitan ng 215 mambabatas na nag-endorso sa reklamo laban sa kanya.
