Posibleng pagtakbo ni PDu30 sa pagka-pangalawang pangulo ng bansa, walang legal impediment- Sec. Roque

WALANG legal impediment o legal na hadlang para kay Pangulong Rodrigo Roa Duterte kung magdesisyon man itong tumakbo sa pagka-pangalawang pangulo sa 2022 elections.

Taliwas ito sa pinalulutang ng ilang grupo.

“Section 4, Article VII of the Constitution is clear : The President shall not be eligible for any re-election. President Duterte is not running for the same office and same position,” ayon kay Presidential Spokesperson Harry Roque.

Kapag maingat na binasa ang Saligang Batas ay lalabas na walang ipinahahayag na probisyon para sa “sitting President” na tumkabo sa mababang public office position.

“Under the plain meaning rule or verba legis, if the statute is clear, plain and free from ambiguity, it must be given its literal meaning and applied without interpretation,” paliwanag ni Sec. Roque.

Inalmahan kasi ng ilang grupo ang legalidad ng posibleng pagtakbo ni Pangulong Duterte sa pagka-pangalawang pangulo.

“On some groups challenging the legality of President Duterte’s Vice-Presidential bid to the Supreme Court, they may rightfully do so as long as they have the legal standing. However, it is is still premature considering the President has not made up his mind and filed his certificate of candidacy,” ayon kay Sec. Roque.
