Patuloy na tinututukan ang kaso ni Rita Daniela: Atty. MAGGIE, hangad na magkaayos ang GMA at mga JALOSJOS

MABABASA sa social media ang estafa case na isinampa ng GMA Network laban sa bigwigs at executives ng Tape Incorporated.

Nag-ugat ito sa diumanoy hindi pagre-remit ng mga Jalosjos sa kanilang commercial ads sa GMA sa noontime show produced na “Tahanang Pinakamasaya” na aabot daw sa P37,941,352.56.

Nagkaroon ng mediation last May 29 kung saan present ang lady lawyer ng GMA at ang celebrity lawyer na si Atty. Maggie Abraham-Garduque na matagal ng legal counsel ng mga Jalosjos brothers na sina Romeo Jalosjos Jr. at Seth Frederick “Bullet” Jalosjos.

Sabi ay hindi raw tinanggap ng GMA ang offer ng Tape Inc. at gusto nila ay bayaran sila agad.

Sa ngayon ay nira-raffle na ang kaso at kung sinong judge ang hahawak nito. Well, in my own opinion, sana ay tumingin naman ang pamunuan ng GMA sa ilang dekadang pinagsamahan nila ng mga Jalosjos partikular na si Mr. Romeo Jalosjos Sr na kilalang producer ng “Eat Bulaga” na mula 1995 hanggang 2023 ay nasa GMA 7 na.

Ayon naman kay Atty. Maggie ay positibo siya na sa huli ay magkakasundo rin ang client niya na Jalosjos at GMA. Saka nagbigay ng reaction ang abogada hinggil sa isinampang kaso ng GMA Network.

“TAPE is still believes that whatever amount is collectible from them by GMA is merely a civil liability, and not a criminal liability for estafa. Foremost, even assuming that the amounts were used by TAPE Inc. for it’s operation instead of remitting it to GMA, this is a mere violation of the assignment agreement being executed between TAPE Inc and GMA Inc.

“Therefore GMA can file a civil case for breach of contract. Secondly, thesw amounts are corporate liability of TAPE Inc and not of it’s individual stockholders. Under the law corporation has separate and distinct personality with it’s stockholders. Thus respondents members of BOD and officers of TAPE were surprised that a criminal case for estafa was filed againts them,” paglilinaw pa ni Atty. Maggie.

“At any rate, we follow the new procedure under the DOJ, circular that the matter will undergo mediation(na nangyari nga last May 29) to settle the differences of the parties. TAPE as a corp today submitted an offer to GMA Inc to be able to settle the amount stated in the complaint which are collectibles of GMA. “This offer will be submitted to GMA and if this is acceptable to GMA, a compromise agreement will be submitted by the parties on the next and last hearing.

If there is no compromise agreement submitted, the case will already be docketed for preliminary investigation.” Pagtatapos pa ni Atty. Maggie, na abala sa pagha-handle ng case ng mga celebrity including Rita Daniela na ongoing ang hearing ng Kapuso actress sa lascivious acts charge nito laban kay Archie Alemania.

Na sa kabila ng not guilty plea ni Archie sa kasong kinahaharap ay patuloy itong ipaglalaban ng actress sa court dahil totoo raw ang kanyang akusasyon.
