WALANG criminal charge ang maaaring isampa laban kay Vice President Sara Duterte dahil sa kanyang naging pahayag na mayroon na siyang taong inutusan na patayin sina Pangulong Ferdinand Marcos Jr., Unang Ginang Liza Marcos, at House Speaker Martin Romualdez sakali’t may masamang mangyari sa kanya.Sinabi ni Chief Presidential Legal Counsel Juan Ponce Enrile na habang binabalaan ang magkabilang panig, hindi malayong samantalahin ng third party ang sitwasyon.
“Although no criminal charge could be made at this time against Sara for her aforesaid statement because it is conditional, care must be taken by both sides to prevent evil third parties from taking advantage of it for their personal benefits, whatever these are,” ang sinabi ni Enrile sa kanyang Facebook account.
“This is a humble suggestion,” dagdag na pahayag nito.
Gayunman, bilang dating Kalihim ng Department of Justice (DoJ) ang “kill threat” ni VP Sara ay mayroong seryosong implikasyon, sabay sabing ang bawat krimen ay mayroong “guilty mind” at “guilty act.”
Aniya, ang kill threat ni VP Sara ay “carries the key principle elements of the criminal case–which says in Latin: ‘Actus non facit reum nisi mens sit rea,’”
“In the aforesaid statement of Sara, the guilty act is the command– ‘patayin mo si BBM. si Liza Araneta, at si Martin Romualdez.’ And the guilty mind is to avenge Sara’s killing, should it happen,” aniya pa rin.
Sinabi ni Enrile kung ang pagtatangka naman sa buhay ni VP Sara ang nangyari subalit hindi naging mataumpay, ang First Couple at ang House Speaker ang agaran at direktang suspek, kahit pa sila ay inosente.
Dahil dito, mas lalawak ang political disruption o pagkagambala sa pulitika sa pagitan ng dalawang partido.
“On the other hand, evil and vicious third parties could merrily take advantage of the situation and weaken, if not destroy, the two sides of the political divide,” ayon kay Enrile.
“Even some ambitious members of each political group could take advantage of it to strengthen and promote their personal interest, whatever that is,” aniya pa rin. (Daris Jose)
