DOJ: Pinaliwanag ang kanilang posisyon sa CDE-LTO requirement

ISANG undersecretary ng Department of Justice (DOJ) ang nagbigay ng paglilinaw ukol sa kanilang posisyon sa pagbibigay ng karagdagang requirement ng Land Transportation Office (LTO) sa renewal ng license.

Sinabi ni DOJ undersecretary Emmeline Aglipay-Villar na ang LTO ay maaari mag impose ng karagdagan requirements para sa pagbibigay ng driver’s license.

Ayon sa balita, ang DOJ ay kinakatigan ang posisyon ng ibang mambabatas na alisain ang Comprehensive Driver’s Education (CDE) na isa sa mga requirements para sa renewal ng driver’s license na 10 years.

“This is incorrect. Our comment submitted to Congress states that it is within the power of the LTO to impose restrictions on the renewal of driver’s licenses for 10 years, which includes the CDE requirement. The issuance of a certification of completion of the CDE is a function necessary, proper or incidental to the power of the LTO to issue driver’s licenses,” sabi n Villar.

Dagdag pa ni Villar na ang function na ito ay nasa ilalim ng LTO at hindi sa mga driving schools o institutions na accredited ng ahensiya.

“While the imposition of the CDE and certification requirement is a function necessary, proper and incidental to the power of the LTO to issue driver’s licenses, it is a function that properly pertains to the LTO and it is not contemplated by EO 1101, Series of 1985, that said function be performed by an LTO-accredited driving school or institution,” dagdag ni Villar.

Ang EO 1101 ay siyang lumikha sa Land Transportation Commission na ngayon ay LTO na.

Noong nakaraang Lunes, naibalita na sinabi ni Deputy Speaker Rufus Rodriguez ng Cagayan de Oro na sinusuportahan ng DOJ ang position niya na alisin ang CDE requirement na siyang requirement sa renewal ng driver’s license.

Ang Resolution 2325 ay hinihimok ang Department of Transportation (DOTr) at LTO na alisin kaagad-agad ang karagdagan requirement sa pagkuha ng certification of completion para sa CDE na kailangan ng motorista sa renewal ng kanilang driver’s license.

Sa ilalim ng rules ng LTO, ang CDE ay puwedeng kunin sa mga accredited na driving school ng LTO na nagkakahalaga ng P3,000 hanggang P5,000. Maari rin makuha ang CDE ng walang bayad sa mga opisina ng LTO.

Nagpahayag din ng kanyang pagkabahala si Rodriguez na maaaring magkaron ng pagkalat ng COVID-19 lalo na ang Omicron dahil ang mga drivers ay dadagsa sa mga opisina ng LTO kung saan sila kukuha ng CDE ng walang bayad.

“The convergence of people at this time in LTO offices, many of which are just cramped spaces in malls, could be a virus super spreader. I’m sure LTO officials and Transportation Secretary Arthur Tugade are aware of this,” saad ni Rodriguez.

Pinaalalahanan din ni Rodriguez ang LTO na maaari itong magbigay daan sa corruption kung ipilit ng LTO ang nasabing requirement na kukunin sa mga accredited driving schools ang CDE. LASACMAR
