PBBM, suportado ang ‘anti-conflict of interest’ memo ng BOC

SUPORTADO ni Pangulong Ferdinand Marcos Jr. ang pagsisikap ng Bureau of Customs’ (BOC) na alisin ang korapsyon at paigtingin ang transparency sa pamamagitan na ipag-utos sa lahat ng mga tauhan at empleyado na ihayag ang anumang ‘family relationship’ sa mga indibidwal na konektado sa customs brokerage industry.

Nauna rito, nagpalabas si Customs Commissioner Ariel Nepomuceno ng Office of the Commissioner (OCOM) Memo No. 39-2025 noong Hulyo 10, na mahigpit na ipinagbabawal sa lahat ng mga opisyal, empleyado at tauhan mula sa pag-asikaso at paghawak ng anumang ‘business o financial interest’ sa customs brokerage operations.

“The policy aims to strengthen good governance and transparency in the agency,” ayon kay Palace Press Officer at Presidential Communications Undersecretary Claire Castro.

“The President has ordered that it is time to put an end to the system that enables corruption and other undesirable practices within the agency. The bureau will prioritize the welfare of the people and not the personal interests of a few,” ang sinabi ni Castro ayon kay Nepomuceno.

Ang naging kautusan ni Nepomuceno ay tinawag na “a historic step towards restoring integrity and public trust” sa BOC, na inilarawan ng marami na kasingkahulugan ng malawakang katiwalian.

Ipinag-uutos ng memo ang isang categorical ban sa anumang pagkakasangkot, direkta man o hindi, sa Customs Brokerage businesses. Kabilang na rito ang papel bilang ‘may-ari incorporator, stockholder, partner, consultant, advisor, o anumang iba pang kapasidad na maaaring magtaas ng mga alalahaning etikal.

Ang lahat ng BOC personnel ay kinakailangan na magsumite ng beripikadong affidavit sa OCOM hanggang Hulyo 20 para ihayag ang anumang familial relationship, sa pamamagitan ng ‘consanguinity o’ affinity’ sa loob ng fourth civil degree, may indibidwal na sangkot sa customs brokerage businesses, maging anuman ang kanilang paper o katayuan sa nasabing entity.

Dapat ding tukuyin sa affidavit ang pangalan, address at contact information ng brokerage na sangkot, kasama ang iba pang mahalagang detalye.

“The disclosure obligation remains mandatory even to personnel who have not been affiliated with the BOC within the last five years,” ayon sa ulat.

Kabilang dito ang customs brokerages na ipinatigil ang operasyon, iyong mga shares ay inalis na o inilipat, o iyong mga indibiduwal na dating nakalista bilang isang incorporator sa kabila ng hindi na humahawak ng interes.

Binalaan naman ni Nepomuceno ang mga BOC personnel na mabibigong tumugon sa polisiya na “will be met with sanctions in accordance with applicable laws.”

Ayon kay Nepomuceno, ang kanyang memo ay pag-uulit lamang sa batas, lao na sa Code of Conduct and Ethical Standards for Public Officials and Employees, at ang Revised Civil Service Rules, at maging ng mga dating BOC memorandum orders.

Naka-angkla rin ito sa Section 12 ng BOC Integrity Action Plan, “which prohibits BOC officials from engaging in business transactions with brokers, importers, or exporters under circumstances that could compromise their duties, and forbids them from holding interests or positions in any private enterprise regulated or supervised by the BOC.”

Samantala, tinawag naman ni Nepomuceno ang ipinalabas na kautusan bilang isang ‘defining step’ sa journey o paglalakbay ng BOC tungo sa ‘institutional integrity.’

“This is more than policy. It is a public declaration that the Bureau of Customs will no longer tolerate practices that breed corruption, favoritism, or undue influence. We are placing public interest above personal gain,” aniya pa rin. (Daris Jose)
