ITO ang naging pahayag ni Rep. Bienvenido “Benny” Abante Jr. matapos magpalabas ng desisyon ang Commission on Elections’ (Comelec) na i-annul ang proklamasyon ni Luis “Joey” Chua Uy ant ideklara si Abante bilang duly elected Representative ng ika-6 na distrito ng Maynila.

Giit ni Abante, malinaw na isinasaad sa konstitusyon na tanging natural-born Filipino citizens ang kuwalipikadong magsilbi sa Kongreso. Kinumpirma ng naging desisyon ng Comelec ang nasabing requirement at prinotektahan nito ang integridad ng demokratikong institusyon.

Sabi pa ni Abante, “This case sets an important precedent. It reminds us that those seeking public office must be held to the highest standards of eligibility and truthfulness. Our people deserve leaders whose allegiance to the country is beyond question, and whose qualifications are beyond doubt.”

Sa naging desisyon, sinabi ng Comelec na nagkaroon ng material misrepresentation si Uy sa kanyang certificate of candidacy (COC) sa pamamagitan ng pagdedeklara nitong natural-born Filipino citizen.

Inihayag ng komisyon na si Uy ay “at most a naturalized citizen” kung kaya hindi ito maaaring kumandidato sa kongreso sa ilalim ng Section 6, Article VI ng 1987 Constitution, kung saan nakasaad na “No person shall be a Member of the House of Representatives unless he is a natural-born citizen of the Philippines.”

Dahil dito, pinawalang bisa ang proklamasyon ni Uy at idineklara si Abante na tanging kuwalipikadong kandidato na nakakuha ng pinakamataas na bilang ng boto ang siyang nahalal na miyembro ng Kamara.

“A natural-born citizen acquires citizenship by birth, without the need for any act or proceeding. Mr. Uy’s case clearly required legal processes under naturalization laws, disqualifying him from ever being considered natural-born,” nakasaad sa ruling.

Iginiit ni Abante na ang isyu ay hindi tungkol sa personalidad kundi sa rule of law. (Vina de Guzman)
