BATAS na nagpapaliban sa Barangay, SK elections sa Disyembre 2022 pirmado na

TININTAHAN na ni Pangulong  Ferdinand  Marcos Jr. ang batas na naglalayong ipagpaliban ang nakatakda sanang  Barangay at Sangguniang Kabataan (SK) elections sa Disyembre 2022.

Nilagdaan ng Pangulo ang Republic Act (RA) No. 11935, nito lamang Lunes,  Oktubre 10, batas  na naglalayong ipagpaliban ang Barangay at SK elections na nakatakda sana sa Disyembre 5  ngayong taon at ginawa na itong huling linggo ng Oktubre sa susunod na taon.

“There shall be synchronized Barangay and Sangguniang Kabataan elections, which shall be held on the last Monday of October 2023 and every three years thereafter,” ang nakasaad sa batas.

Sa ilalim ng RA 11935, ang term of office ng mga mahahalal na mga barangay at SK officials ay magsisimula sa Nov. 30 matapos ang eleksiyon.

“Until their successors shall have been duly elected and qualified, all incumbent Barangay and Sangguniang Kabataan officials shall remain in office, unless sooner removed or suspended,” ayon sa batas.

Sinasabing ipagpapatuloy ng mga Barangay at SK officials  na  pawang mga ex officio members ng Sangguniang Bayan, Sangguniang Panlungsod, o Sangguniang Panlalawigan ang pagseserbisyo hanggang sa susunod na Barangay at SK elections maliban na lamang kung aalisin sa puwesto.

“The amount necessary for the implementation of RA 11935 will be taken from the appropriations of the Commission on Elections under the General Appropriations Act and/or supplementary appropriations,” ayon sa RA 11935.

“If any portion or provision of this Act is declared unconstitutional, the remainder of this Act or any provisions not affected thereby shall remain in force and effect,” ang nakasaad pa rin sa RA 11935.

“All other laws, acts, presidential decrees, executive orders, issuances, presidential proclamations, rules and regulations which are contrary to and inconsistent with any provision of RA 11953 are repealed, amended, or modified accordingly,” ayon pa rin sa nasabing batas.

Kung maalala una nang pinagtibay ng Senado at ng Kamara ang consolidated version ng House Bill No. 4673 at Senate Bill No. 1306 noong Sept. 28, 2022 sa kabila ng pagtutol ng ilang grupo, tulad ng Namfrel at iba pa. (Daris Jose)
